An Ottawa murder defendant wants to know what happened to autopsy X-rays and slides.
Kenneth Cusick, 50, was charged Feb. 28 with murdering his wife, Tracy Cusick, in 2006 in their Ottawa home. Cusick is out of custody on $500,000 cash bond.
Cusick's attorney, Ryan Hamer, said in a court filing Thursday the pathologist who did the second of two autopsies on Tracy made a report in which he mentioned X-rays and slides. Hamer said he asked prosecutors for the images, but was told they did not have them and did not know if the materials exist. Hamer wants the materials to prepare Cusick's defense.
Hamer also reached out to the pathologist, but did not receive a response.
As a consequence, Hamer said if images are lost or destroyed, he wants prosecutors to explain how the materials were collected and preserved, and if destroyed, the date of destruction.
The next court hearing is Thursday.
